Paycentric’s total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by the user for the service during the 12-month period preceding the claim. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of South Africa. Any legal disputes arising out of or in connection with these terms, including disputes regarding the use of the Paycentric services, shall be subject to the exclusive jurisdiction of the courts located in South Africa. By using our services, you consent to the jurisdiction and venue of these courts for the resolution of any such disputes.

Dispute Resolution

Any disputes arising out of or in connection with these Terms of Service will first be addressed through good-faith negotiations between the parties. If a resolution cannot be reached, the dispute will be resolved through binding arbitration, conducted in accordance with the rules of the Arbitration Act of 1965 or the International Arbitration Act of 2017 (for international disputes), under the jurisdiction of South Africa. Both parties agree to submit to the exclusive jurisdiction of the arbitration process and waive their right to pursue litigation in court, except for claims related to intellectual property or as otherwise required by law. Additionally, users agree to waive any right to participate in class action lawsuits or class-wide arbitration related to these Terms of Service. Arbitration decisions will be final and binding, and each party will bear their own costs unless the arbitrator determines otherwise. This arbitration process is designed to be quicker and more flexible than traditional litigation, and the award made by the arbitrator will be enforceable by South African courts.
